Tax residency in Georgia

Georgia operates a dedicated regime for high-net-worth individuals. It is comparatively clearly regulated — the real hurdle is not in Georgia but in leaving your previous tax jurisdiction behind.

Assets in Georgia worth at least €460,000 are one of the three requirements — property counts towards them.

What the HNWI regime requires

A private individual can obtain tax residency in Georgia when three conditions come together. First, a net worth of at least €1,010,000 — or, as an alternative, an annual income of €67,000 in each of the three preceding years. Second, assets in Georgia worth at least €460,000, where real estate, cash and cryptocurrency all count. Third, a connection to the country in the form of a residence permit.

The requirements run in parallel, not in sequence. Only the work permit and the residence permit build on one another.

How the timing works

Proof of funds over €1.01m depends on how quickly it can be produced. Proof of the €460,000 in an account takes about a week from opening it. Registration as a sole trader and setting up the bank account are completed within five days once all documents are in hand. The residence permit follows thirty days after the small-business status is activated; the asset check and document preparation take four working days.

Here too: the residence permit application has to be filed in person while you are in Georgia. Processing can then continue without you being present.

Where the real difficulty lies

Being taken on by Georgia is one thing. Getting out of your existing tax liability is another — and that is decided not by Georgian law but by the law of your previous country of residence. Germany, Austria and Switzerland each have their own rules on domicile, habitual residence and exit taxation. Underestimate this part and you end up with two tax jurisdictions rather than none.

For people without an established tax residency, or those who have already left their previous tax jurisdiction, there is a tax relocation package. It covers the residence permit and residence card, a registered official address, address documentation, and the preparation and filing of the first tax returns for the first three months.

What applies for tax in Georgia

Rental income is taxed at one per cent. Capital gains on property are tax-free after a two-year holding period; on a sale within the first two years, five per cent applies. These rates apply whether or not you are tax resident in Georgia — they attach to the property, not to the person.

Common questions

What people ask most about this.

What are the requirements for tax residency in Georgia?

A net worth of at least €1,010,000, or an annual income of €67,000 in each of the past three years, plus assets in Georgia of at least €460,000 and a Georgian residence permit.

Does a property count towards the €460,000 in assets?

Yes. Assets in Georgia include real estate, cash and cryptocurrency. A property can therefore cover this proof in whole or in part.

How high is the tax on rental income in Georgia?

One per cent. Capital gains on property are untaxed after a two-year holding period; on a sale within two years it is five per cent.

Is Georgian tax residency enough to end my German tax liability?

No, that is decided by German law alone. What matters is domicile, habitual residence and, where applicable, exit taxation. Georgian residency on its own ends no existing liability. Have this part checked by a tax adviser in your previous country of residence.

How long does the whole process take?

The requirements run in parallel. Proof of account about a week, registration and account setup within five days, the residence permit thirty days from activation of the small-business status, the asset check four working days.

The law, the fees and exchange rates change; Georgian amounts are usually settled in US dollars or lari. Have your case checked independently before you decide.
